General Terms and Conditions (GTC)

for services of Resch Krahé Haus GbR – crispycoaching

1. Scope

These General Terms and Conditions (GTC) apply to all offers and services provided by Resch Krahé Haus GbR – crispycoaching, particularly coaching sessions, trainings, seminars, workshops, consulting projects, digital learning programs, and other educational formats conducted online, at the client’s location, in our own premises, or at external venues.

The GTC apply to consumers and businesses unless otherwise expressly stated.

2. Conclusion of contract

Our services are booked exclusively after individual arrangements – via email, our contact form, phone, or specific registration forms.

a) In-house Trainings & Corporate Projects

For in-house services (e.g., internal company trainings, coaching programs, project days), we usually submit a written offer or a customized concept.

A contract is concluded by:

  • written confirmation of the offer by the commissioning organization (email suffices), or
  • an explicit verbal agreement combined with the subsequent scheduling or preparation of the service by crispycoaching.

Even without a formal conclusion of a contract, the commissioning is deemed binding if the client expects the service to be provided by crispycoaching based on an offer, draft, or concept or actively initiates it (e.g., by scheduling appointments, booking rooms, inviting participants).

Additionally, our cancellation policies apply (see section “Cancellation / Rescheduling” of these GTC).

b) Open Trainings & the “Lead Yourself” Program

For open trainings or programs such as “Lead Yourself,” the contract is concluded upon registration and our subsequent confirmation along with the invoice. Participation is only guaranteed after full payment. The number of participants is limited, and places are allocated in the order of registration.

c) Coaching Sessions

Coaching is booked exclusively as packages starting from 6 hours. The contract is concluded with the booking and invoice issuance. The service will only be provided after full payment.

3. Types of Services

We offer the following formats:

  • In-house Trainings
    Custom-designed trainings, workshops, and coaching sessions for individual companies – conducted in person or online.
  • Open Trainings (crispy academy)
    Seminars attended by individuals or teams from various companies – mostly scheduled on fixed dates, bookable subject to availability.
  • Coaching Sessions
    Individual or team formats, bookable only in advance as hour packages, redeemable flexibly over an extended period.
  • Digital Learning Program “Lead Yourself”
    A multi-week online program with self-study phases, digital and print materials, and live sessions – conducted in clearly defined cohorts at set times. The program can also be completed individually upon request.
  • Consulting Services and Project Formats
    Tailored support for companies in leadership, team, or organizational development processes. These include needs assessments, concept development, strategy workshops, facilitation, and project-related measures. Implementation is carried out in close coordination with the client – online or on-site.

4. Payment Terms

  • Coaching: Only bookable as packages of at least 6 hours. Payment must be made in advance. Hours can be used flexibly within 24 months. Unused hours expire thereafter.
  • Lead Yourself: Participation fee must be paid in advance. Access to the program, learning platform, and dispatch of materials is activated only after payment is received.
  • Open Trainings: Advance payment upon invoicing. The seat is only secured after payment is received.
  • In-house Trainings: Usually invoiced after the service is provided. For multi-month projects, partial invoicing applies.
  • Service Packages / Annual Credits: Paid in advance and must be used entirely within the following calendar year. crispycoaching reserves the right to restrict scheduling during high-demand periods (e.g., year-end) and shift services to quieter periods (e.g., summer).

5. Rescheduling and Cancellations

a) Coaching Sessions

  • Up to 48 hours before the session: rescheduling is free of charge
  • Less than 48 hours or no-show: session is considered conducted

b) Open Trainings (crispy academy)

  • Up to 30 calendar days before the start: free rescheduling
  • After that: only possible with a doctor’s note or substitute participant
  • In case of no-show or last-minute cancellation without a doctor’s note: no refund

c) Lead_Yourself

  • Up to 30 calendar days before program start: free rescheduling to the next cohort
  • 15–30 days before start: 50% of the participation fee
  • From 14 days before start: no refund possible
  • Replacement participation in another cohort is possible by arrangement, provided access has not yet been used.

d) In-house‑Trainings

For rescheduling or cancellation of an already scheduled in-house appointment, the following rules apply:

  • Up to 30 calendar days before the appointment: free of charge
  • 29 to 15 calendar days before: 25% of the agreed fee
  • 14 to 7 calendar days before: 50%
  • 6 to 4 calendar days before: 75%
  • From 3 calendar days before (including no-show): 100%

Rescheduling is considered a cancellation unless a new binding date is agreed immediately.

Compensation for Cancellation of Major In-house Projects

For in-house training, coaching, or project assignments with a net order volume of €20,000 or more and already scheduled service dates, the following applies – in addition to the above cancellation policies:

  • If the client cancels the project after accepting the offer, a flat-rate compensation for effort and blocking costs of €5,000 net is due.
  • The client is expressly entitled to prove that no or significantly less damage occurred.
  • Further statutory claims by crispycoaching remain unaffected.

6. Execution & Changes

crispycoaching reserves the right to cancel or postpone open trainings or programs due to low registration numbers or for organizational reasons. Participants are usually informed no later than 14 calendar days before the originally scheduled date. In such cases, they will receive a place in the next available cohort. If the new date is too far in the future for individual reasons, crispycoaching offers a one-time 30-minute online coaching session on a current topic as compensation.

A refund of the participation fee is only granted in exceptional cases and upon individual agreement. Further claims, especially for damages, do not apply.

crispycoaching is also entitled to replace announced trainers or coaches for valid reasons – especially in case of illness, force majeure, or unforeseen circumstances – with equally qualified professionals. A change of trainer does not entitle the participant to cancel or reduce the participation fee or agreed daily/hourly rate.

7. Travel, Accommodation & Project Management Costs

Flat-rate Travel Expenses

  • Domestic (Germany): crispycoaching charges a flat rate of 8% of the net order value for on-site services.
  • Abroad: For services outside Germany, a flat rate of 12% of the net order value is charged.

Scope of Flat Rates

The flat rates cover all travel, accommodation, and meal costs of the assigned trainers/consultants.

Deviating Actual Costs

If individual travel days become exceptionally expensive due to external factors (e.g., trade fairs, short notice, strikes), crispycoaching may – after prior consultation with the client – charge additional costs based on proof.

Project Management Effort

For project clarification, goal definition, scheduling, feedback, and coordination loops, crispycoaching charges a project management fee of 10% of the net project volume for projects exceeding €5,000.

Not Included in Flat Rate

Documentation, detailed preparation/follow-up, result protocols, and other additional services – if commissioned – will be invoiced separately based on actual time at the current hourly rates.

Purely Digital Services

For fully digital formats (online trainings, e-coachings, webinars), no travel cost flat rates apply; the project management fee remains unaffected.

Invoicing

Travel, accommodation, and project management costs are invoiced together with the fee and are payable immediately. Deviating arrangements require written agreement.

8. Copyright and Usage Rights

All content (e.g., materials, concepts, methods, recordings) is protected by copyright.

They may only be used for personal, non-commercial purposes.

Any distribution, publication, reproduction, or commercial use is prohibited. The contents of the “Lead Yourself” program are copyrighted and released for personal use only.

9. Liability

Unlimited Liability

crispycoaching is fully liable for damages resulting from:

  • intent or gross negligence,
  • injury to life, body, or health,
  • assumption of a guarantee,
  • the Product Liability Act, or
  • mandatory provisions of the GDPR.

Liability for Slight Negligence

For slightly negligent breaches of essential contractual obligations (cardinal obligations), liability is limited to the typical, foreseeable damage; however, it does not exceed twice the net order value or €50,000, whichever is lower.

Liability for slight negligence outside of cardinal obligations is excluded.

Exclusion of Indirect Damages
crispycoaching is only liable for indirect or consequential damages – especially lost profits, production downtime, missed savings, or other financial losses – in cases of intent or gross negligence.

Client and Participant Responsibility
The content of coaching, trainings, consulting, or digital programs does not constitute legal, tax, financial, or medical advice. Decisions, actions, or omissions made by clients or participants based on the content are their own responsibility; no success guarantee is given.

Venues and Personal Belongings
Participants enter training and coaching venues or external locations at their own risk. crispycoaching is only liable for accidents if the damage is based on culpable violation of legal traffic safety obligations under clause 1 or 2.
No liability is assumed for loss or damage to personal belongings unless caused by intent or gross negligence by crispycoaching.

Indemnification for Third-party Damages
The client indemnifies crispycoaching against all claims from third parties resulting from unlawful or contractual misuse of services by the client or its participants.

Statute of Limitations
Claims for damages against crispycoaching expire one year after knowledge of the damage and injuring party, but no later than three years after performance. This does not apply to claims under clause 1.

10. Data Protection

The processing of personal data is carried out in accordance with our privacy policy.

By booking, clients agree to the processing of their data for contract fulfillment purposes.

11. Right of Withdrawal for Consumers

  1. a) Exclusively Business Transactions

Our offers are generally directed at businesses (§ 14 BGB). For contracts concluded exclusively with businesses, there is no statutory right of withdrawal.

(b) Consumers / Private Payers

If a natural person becomes a contractual partner as a consumer (§ 13 BGB), the following right of withdrawal applies, unless a statutory exception exists:

Withdrawal Policy
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date of contract conclusion.

by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the withdrawal form provided at the end of these GTC, but it is not mandatory.
To meet the deadline, it is sufficient to send your notice before the withdrawal period expires.

Consequences of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you without undue delay and at the latest within fourteen days from the day we receive your notice of withdrawal. For this refund, we will use the same payment method you used in the original transaction unless otherwise expressly agreed.
If you requested the service to begin during the withdrawal period, you must pay us a reasonable amount corresponding to the portion of the service already provided up to the time you notify us of your withdrawal (§ 357 VIII BGB).

(c) Exceptions

The right of withdrawal does not apply to contracts:

  • for services related to leisure activities, if the contract provides for a specific date or period (§ 312g II No. 9 BGB), in particular open in-person trainings or workshops with a fixed date;
  • for the delivery of digital content if we have begun performance with your express consent before the end of the withdrawal period and you have confirmed that you lose your right of withdrawal upon execution (§ 356 V BGB).

(d) Commencement of Execution Before Expiry of Withdrawal Period

For digital learning programs or online coaching that are activated immediately, we request the following declaration from consumers before service begins:

“I expressly request that crispycoaching begins providing the service before the withdrawal period ends. I understand that I lose my right of withdrawal once the service is fully provided.”

  1. Final Provisions

If individual provisions of these GTC are wholly or partially invalid, the validity of the remaining provisions remains unaffected.

German law applies. Place of jurisdiction – where legally permissible – is Berlin.

Data protection

The use of our website is generally possible without providing personal data. Insofar as personal data (e.g. name, address or e-mail addresses) is collected on our website, this is always done on a voluntary basis. This data will not be passed on to third parties without express consent.

We would like to point out that data transmission over the Internet (e.g. when communicating by e-mail) may be subject to security vulnerabilities. Complete protection of data against access by third parties is not possible.

We hereby expressly prohibit the use of contact data published within the scope of the imprint obligation by third parties for sending unsolicited advertising and information material. The operators of this website expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam e-mails.
